Creditor's Rights & Bankruptcy

SandersBaker
has a long history in the debtor/creditor area, especially representation of health care providers and financial institutions. Nearly all of our lawyers work in some aspect of the creditors' rights area; however, suggested contacts are provided below.

Business and Agricultural Bankruptcy. Creditor representation in all Texas and New Mexico based bankruptcy courts; representation of both debtors and creditors in commercial and agricultural reorganization, including Chapters 11 and 12 of the Bankruptcy Code. Bankruptcy Trustee Litigation. Litigation on behalf of or against bankruptcy trustees and other fiduciaries in bankruptcy and insolvency litigation. This includes prosecution and defense of preference actions and similar proceedings arising under the Bankruptcy Code and other special statutes.

Real Property Foreclosure. Using firm personnel and a statewide network of lawyers and law firms, SandersBaker provides real property foreclosure services throughout Texas. We are also one of the first firms to assist lenders with foreclosure of home equity loans. Suggested contacts: Roger S. Cox.

Health Care Cost Recovery. SandersBaker represents hospitals and health care providers throughout Texas and adjoining states in specialized health care cost recovery. This includes hospital lien enforcement, third party and managed care payment, and standard collection practice, tailored to hospitals and other health care practices. Workouts & Debt Restructuring. Negotiation and documentation of agreements evidencing the restructuring or liquidation of commercial debt. Suggested contacts: Art Baker or Roger S. Cox.

Receiverships. Service as receivers and counsel for receivers in state court receiverships. Our lawyers have served as receivers in some of the more successful receiverships in the Amarillo area, resulting in substantial recovery for unsecured creditors and shareholders of otherwise insolvent entities. Special Asset Enforcement. Collection efforts, litigation; extraordinary remedies including garnishment and attachment. These matters are handled by most lawyers in the firm, depending upon the area of expertise.
